SpellBound: Survival (the "Game") is operated by Havoc Interactive, an independent game development studio. All services provided through spellboundsurvival.com — including gameplay access, in-game purchases, guilds, leaderboards, and user accounts — are governed by our Terms of Service, Privacy Policy, and Refund Policy.

2. Live Game Disclaimer

SpellBound: Survival is a live game with frequent updates. As a live game:

Mechanics, balance, and features are regularly updated and subject to change.
New content may be added; existing content may be modified or removed.
Service interruptions or downtime may occur during maintenance.
While we prioritize data preservation, no absolute guarantee is provided.

By playing, you acknowledge that Havoc Interactive is not liable for changes resulting from updates, rebalancing, or maintenance.

3. Digital Purchases and Refunds

All purchases through the Game or website are digital content transactions.

By confirming a purchase you expressly agree that:

Digital content is delivered immediately, and
You waive your statutory right of withdrawal under Article 16(m) of the EU Consumer Rights Directive (2011/83/EU) and equivalent Swiss consumer principles.

All digital purchases are final and non-refundable once delivered. Limited exceptions (duplicate billing, verified non-delivery, unauthorized payment) are described in the Refund Policy.

4. User Responsibilities and Fair Play

Users must follow the SpellBound Code of Conduct as defined in the Terms of Service. Strictly prohibited actions include:

Bots, macros, automation, or any third-party cheat tool
Exploiting bugs or unauthorized third-party tools
Harassment or abusive conduct
Manipulation of the game economy or leaderboards
Bypassing anti-cheat or server-authoritative validation

Violations may result in account suspension or permanent ban without refund.

5. Data Protection and Privacy

Havoc Interactive processes personal data in compliance with:

The EU General Data Protection Regulation (GDPR)

We collect and use personal data only as necessary for:

Account creation and authentication
Gameplay, multiplayer, and social features
Anti-cheat, security, and fraud prevention

6. Intellectual Property

Havoc Interactive is governed by French law. Any disputes arising from use of the Game or website shall be submitted to the competent courts of Paris, France, unless mandatory local consumer protection law provides otherwise.
