SpellBound: Survival

1. Acceptance of Terms

By accessing or using SpellBound: Survival (the "Game"), including its website, in-game storefront, dashboard, or any associated services, you agree to be bound by these Terms of Service (the "Terms"), our Privacy Policy, and our Refund Policy. If you do not agree, do not use the Game or any related service.

SpellBound: Survival is a live, actively developed game. Gameplay, features, balance, and content may change at any time without prior notice.

2. Eligibility

You must be at least 16 years old to use the Game. If you are under 18, you must have parental or guardian consent. You confirm that all information you provide is accurate and that you are not legally prohibited from using online digital services.

3. Account Registration and Responsibility

Certain features require an account. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs on your account. You agree not to share, sell, gift, transfer, or otherwise dispose of your account. Havoc Interactive reserves the right to suspend or terminate any account suspected of violating these Terms, exploiting the Game, or compromising service integrity.

4. Live Game Disclaimer

SpellBound: Survival is a live game that receives frequent updates. This means:

• Content, balance, and mechanics may change without notice.
• Features may be added, modified, or removed at any time.
• Servers may be temporarily unavailable during maintenance.
• While we strive to preserve player data, no absolute guarantee of persistence is given.

By using the Game, you accept these conditions and agree that Havoc Interactive is not responsible for changes resulting from updates, maintenance, or rebalancing.

5. License and Ownership

Havoc Interactive grants you a limited, non-exclusive, revocable, non-transferable license to access and use the Game for personal, non-commercial purposes. All content — including code, art, design, mechanics, characters, storyline, sound, and branding — remains the exclusive property of Havoc Interactive. You acquire no ownership rights over any in-game item, currency, character, or unlock. You may not copy, distribute, modify, reverse-engineer, decompile, or exploit any part of the Game without our written authorization.

6. Fair Play and Player Conduct

You agree to use the Game in good faith and refrain from any misconduct, including:

• Using bots, macros, automated scripts, or third-party cheat tools.
• Exploiting bugs, glitches, or unintended behaviour.
• Harassment, hate speech, threats, doxxing, or abusive conduct.
• Account sharing, boosting for hire, or account trading.
• Real-money trading of in-game items, currencies, or characters.
• Bypassing anti-cheat, rate limiting, or server-authoritative validation.

We operate an industry-standard tiered moderation system. Repeated or severe violations escalate from warnings and temporary suspensions to permanent bans without refund.

7. Digital Purchases and Monetization

The Game offers optional in-game purchases — including gem packs, cosmetics, characters, and other digital content — processed by trusted third-party providers such as Stripe and PayPal. By making a purchase you acknowledge and agree that:

• Digital content is delivered instantly upon successful payment.
• All purchases are final, definitive, and non-refundable once delivery has occurred. No refunds are granted for buyer's remorse, unused content, account sanctions, or dissatisfaction with game balance.
• You are buying a license to access digital content, not ownership.
• In-game items and currencies have no real-world monetary value and cannot be cashed out.

Limited exceptions (duplicate charge, non-delivery, unauthorized payment) are described in our Refund Policy. We reserve the right to change, remove, or reprice any purchasable content at any time without notice.

8. Enforcement Actions

Havoc Interactive enforces a progressive sanction system:

• Warning or short suspension for first offences.
• 7–30 day suspension for repeated misconduct.
• Permanent ban without refund for severe or repeat violations, cheating, or fraud.

All enforcement decisions are final at our sole discretion.

9. Limitation of Liability

The Game is provided "as is" and "as available" without warranty of any kind. To the fullest extent permitted by law, Havoc Interactive disclaims liability for:

• Loss of data, progress, gold, gems, or in-game items.
• Service interruptions, downtime, or degraded performance.
• Unauthorized access to accounts caused by user credential mishandling.
• Any indirect, incidental, consequential, or punitive damages.

Our aggregate liability for any claim relating to the Game shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Modifications to Terms

We may update these Terms at any time. When we do, the "Last updated" date at the top of this document will change. Continued use of the Game after changes constitutes acceptance of the updated Terms.

11. Termination

We reserve the right to suspend or terminate your access to the Game at any time, for any reason, without prior notice or liability, including for violation of these Terms.

12. Governing Law and Jurisdiction

These Terms are governed by French law. Any disputes shall be submitted to the competent courts of Paris, France, unless mandatory local consumer protection law provides otherwise. EU users may also access the EU Online Dispute Resolution Platform at https://ec.europa.eu/consumers/odr.
